Key Takeaway  In November of 2018, institutions were made aware of the Department of Education’s Office for Civil Rights intent to modify the Title IX regulations through the Notice of Proposed Rulemaking process. Participants will hear about key changes made in the final regs and suggestions for moving forward in preparation for the August 14th, 2020 implementation date. Challenge The new regulations are very different from what the original regs passed in 1975 were. In the last 9 years, institutions have continued to struggle with the ambiguous or unclear regs, choosing to turn to the Dear Colleague Letters or other types of significant guidance for assistance. In doing so, institutions engaged in good faith efforts to comply given the lack of regulatory clarity. This webcast will help institutions to understand what some of the more prominent, generalized changes to the regs are, and ways in which institutions can begin to work towards implementation of the new requirements by August 14th. Overview Title IX of the Education Amendments Act of 1972 changed the landscape of education and sought to level the playing field for women across the nation. Since then, a series of court cases helped to largely define the scope of Title IX in its application and analysis of various cases throughout the 1990s. For the most part, the Title IX implementing regulations remained unchanged since they were adopted; and for most institutions, the application of Title IX beyond athletic realms remained unknown to many. Since the publication of the 2011 Dear Colleague Letter by the Obama administration, educational institutions have begun to focus on campus sexual assault and harassment as required under the Title IX implementing regs. Since July of 1975, when the regs were first implemented, there has not been a lot of changes to accommodate the growing number of campus sexual assault allegations. As a result, the federal requirements as written were often filled with gaps and difficult for institutions to implement. On May 6th, 2020, the Title IX proposed regs were finalized, leaving institutions scrambling to meet the required August 14th, 2020 implementation date.
